NOTIFICATION: Permission to use this product (“Software”) is conditional upon you as the customer and licensee (“You”) agreeing to the terms set out below (this “Agreement”)

If You do not wish to accept the following terms do not select the [“I AGREE”] Button and the Software will not install on to Your computer, mobile or mobile computing device (“Device”). In circumstances where You purchase the Software without accepting the terms of this Agreement and wish to return the Software please contact PC Tools to determine whether You are eligible for a refund.

License
1. 1.1 If You are a resident of Oceania at the time You either first purchased or first installed the Software (whichever occurred first), then the licensor of the Software is an Australian Company, PC Tools Pty Ltd ACN 108 759 208 and the parties to this Agreement will be You and PC Tools Pty Ltd ACN 108 759 208. If You are not a resident of Oceania at the time You either first purchased or first installed the Software (whichever occurred first), then the licensor of the Software is an Irish Company, PC Tools Limited (Irish Company Number 426110) and the parties to this Agreement will be You and PC Tools Limited (Irish Company Number 426110). For the purposes of this Agreement, the licensor (being either PC Tools Limited or PC Tools Pty Ltd) will be referred to as "PC Tools". For the purposes of this Agreement, "Oceania" means American Samoa, Antarctica, Australia and its outside territories, including Heard Island & McDonald Islands, Cocos (Keeling) Islands, Christmas Island, Ashmore & Carter Islands, and Coral Sea Islands, Cook Islands, Fiji, French Polynesia, Guam, Kiribati, Marshall Islands, Federated States of Micronesia, Nauru, New Caledonia, New Zealand, Niue, Norfolk Island, Northern Mariana Islands, Palau, Papua New Guinea, Pitcairn Islands, Samoa, Solomon Islands, Tokelau, Tonga, Tuvalu, Vanuatu and Wallis and Futuna Islands.
2. 1.2 PC Tools has agreed to license use of the Software to You pursuant to this Agreement and the terms and conditions set out below.
3. 1.3 PC Tools grants to You a non-exclusive, non-transferable, revocable license to:
  - (a) install and execute the Software;
  - (b) make one additional copy of the Software for backup purposes only; and
  - (c) use the Software strictly in accordance with the provisions of this Agreement during the subscription period specified for that Software.
4. 1.4 The number of Devices on which You are entitled to install and execute the Software is specified at the time of purchase. If You wish to install the Software on more than this number of Devices, You may only do so upon receipt of written consent from PC Tools and upon payment of an additional license fee as stipulated by PC Tools.
5. 1.5 Your license to use the Software as granted herein only permits You to use the version of the Software which You have installed or purchased from PC Tools. Some products will include Your rights to receive automatic updates, enhancements and improvements of the Software and these will be provided to You by PC Tools at its sole discretion. Some products may require You to upgrade to a more recent version if You wish to avail Yourself of the support services by PC Tools in relation to that particular product. These upgrades are usually offered as part of the subscription provided to You or may be required as part of PC Tools product lifecycle. If You receive such an update or improvement, such Software shall automatically be deemed to be a part of the Software licensed to You under this Agreement. If You enter into a separate agreement with PC Tools for the supply of any other product or updates of the Software then such a separate Agreement will govern the use of those products and updates.
6. 1.6 You acknowledge that PC Tools may offer to maintain and update the Software but it is not obliged to do so unless You have purchased a subscription that entitles You to updates for a specified period, or You purchase a separate maintenance contract. If no subscription period is specified at the time You purchase a license for this product, the subscription period will be one (1) year from the date You either first purchased (in the case of online downloads) or first installed the Software (in the case of retail purchases). Should You wish to receive information about updates please view PC Tools website on a regular basis at www.pctools.com.
7. 1.7 If You have purchased a subscription that entitles You to updates, or You purchase a separate maintenan+-ce contract, You acknowledge that after the specified subscription period or maintenance period has expired, You have no further right to receive any updates without the purchase of a renewal or new subscription or maintenance contract. You also acknowledge that PC Tools may limit the functionality of the Software upon the expiry of any subscription period or maintenance period unless You purchase a new subscription or maintenance contract.
License Fee
1. 2.1 Where a license fee is payable by You in respect of the Software, You are not entitled to use the Software until the license fee has been paid and then only for the period of the subscription (where specified). In the case of payment by credit card, payment will not be deemed paid until the credit card payment has been authorized by the billing provider. A separate license fee is payable in the circumstances described in clause 1.4.
2. 2.2 However, You are not entitled to receive technical support nor the full functionality that comes with the Software until a license fee has been paid.
Licensee's Obligations
1. 3.1 As the Licensee You hereby undertake the following obligations:
  - (a) to not print, copy, reproduce, translate, adapt, vary, alter, change, reverse engineer, decompile or modify the Software by any means or in any other form, other than to make one temporary copy of the Software for back-up and security purposes, without the express consent of PC Tools, except as expressly authorized by this Agreement and subject to Your rights under applicable law;
  - (b) to supervise and control the use of the Software in accordance with the terms of this Agreement;
  - (c) to ensure Your employees, sub-contractors and other agents who have authorized access to the Software are made aware of the terms of this Agreement;
  - (d) to not provide or otherwise make available the Software in any form to any person other than those referred to in paragraph (c) without the written consent of PC Tools;
  - (e) to not give, lease, assign, license, sub-license, transfer, distribute, disclose, disseminate or publish the Software in any form to any other person or attempt to do any of these acts;
  - (f) to not alter, change, remove or obscure any notices or other indications (including copyright notices) as to ownership of the Software;
  - (g) not to access or use the Software on more than one personal stand-alone Device, or otherwise allow the Software to be accessed or used by more than one user at any one time except as expressly authorized by this Agreement;
  - (h) to not engage in any acts which infringe PC Tools intellectual property rights in the Software; and
  - (i) to not use the Software in automatic, semi-automatic or manual tools designed to create virus signatures, virus detection routines, any other data or code for detecting malicious code or data.
2. 3.2 You acknowledge that the License granted by clause 1 does not make You the owner of the Software nor does it cause any transfer or assignment of any copyright or any other intellectual or industrial property rights subsisting in the Software to You.
3. 3.3 If you have licensed antivirus Software, you acknowledge that the Software will seek to remove codes such as viruses, spyware, adware and malware. In some circumstances removal of detected code may result in You breaching a license to use the host software which originally installed the code and may result in host programs to cease operating. You agree to consult the terms of any license agreement for the host program before authorizing the removal of any viruses, spyware, adware or malware associated with that program.
Warranty
1. 4.1 You hereby acknowledge that the Software may not be uninterrupted and cannot be guaranteed error free and further acknowledge that the existence of any such errors shall not constitute a breach of this Agreement by PC Tools. In particular, PC Tools does not guarantee that the Software will (i) detect and/or remove all known viruses, spyware, adware, malware, Trojans, keyloggers and trackware, or locate all browser infections and tracking cookies on Your Device, nor that the Software will not occasionally erroneously report a virus in a file or system not infected by that virus; (ii) recover or detect all undeleted files which are present on Your Device; (iii) block all threats on Your Device, including from malicious websites or potential hackers; (iv) detect and/or filter all spam or junk email; or (v) detect, remove or rectify any errors on Your Device, including, without limitation any errors in Your Windows registry file or other operating system errors. If the Software is a beta version, You acknowledge and agree that (i) the Software may contain errors and defects and may not function as intended or in accordance with its specifications; and (ii) You assume all risk in using the Software and agree to take due care in the installation, execution and testing of the Software on Your Device’s system.
2. 4.2 The particular operating systems upon which the Software has been designed to execute will be published by PC Tools from time to time ("Compatible OS"). You agree that You will not execute or install the Software on any operating system other than a Compatible OS. You acknowledge and agree that the Software may not execute correctly and may interfere with other software if executed on an operating system which is not a Compatible OS.
3. 4.3 In the event that any terms, conditions, representations or warranties are implied by statute, common law or equity ("Prescribed Terms") into this Agreement which cannot be lawfully excluded, the Prescribed Terms will apply to this Agreement, save that the liability of PC Tools for breach of any Prescribed Terms will be limited, to the extent permitted by law, at the option of PC Tools, to any one or more of the following:
  - (a) the replacement of the Software to which the breach relates or the supply of equivalent Software;
  - (b) the repair of the Software;
  - (c) the payment of the cost of replacing the Software or of acquiring equivalent Software; or
  - (d) the payment of the cost of having the Software repaired.
4. 4.4 If the liability of PC Tools for breach of any Prescribed Terms is capable of exclusion, they are hereby excluded to the fullest extent permitted by law.
5. 4.5 Except as provided by the Prescribed Terms (if any), which are not capable of exclusion or limitation, or as expressly set out in these terms:
  - (a) PC Tools makes no warranties in relation to the Software, including warranties as to the performance or fitness for purpose of the Software (other than that PC Tools is entitled to grant to You the rights set out in this Agreement);
  - (b) You will not under any circumstances have any cause of action against, or right to claim or recover from, PC Tools for or in respect of any loss, damage or injury (including without limitation any loss of profit, indirect or consequential loss, damage or injury) arising from the supply or use of the Software or any breach of these terms; and
  - (c) subject to paragraph (b) above, the maximum liability of PC Tools to You in respect of any breach of this Agreement or otherwise in respect of Your use of the Software will be the amount You have paid PC Tools for the Software and if You have not paid PC Tools any amount for the Software, will be the amount of US $1 (one US dollar).
6. 4.6 PC Tools will not be liable for any indirect or consequential damages arising out of a breach of this Agreement or arising out of the supply of the Software.
7. 4.7 You acknowledge that You have exercised Your independent judgment in acquiring the Software and have not relied upon any representations made by PC Tools which have not been stated expressly in this Agreement or upon any descriptions or illustrations or specifications contained in any document including catalogues or publicity material produced by PC Tools.
Copyright and Trade Marks
1. 5.1 You acknowledge that the Software and all related products (including but not limited to Device manuals and Device literature) ("Products") are the subject of copyright. You therefore, shall not during or any time after the expiry or termination of this Agreement, permit any act which infringes that copyright and, without limiting the generality of the foregoing, You specifically acknowledge that You may not copy the Software or Products except as otherwise expressly authorized by this Agreement.
2. 5.2 You shall not during or at any time after the expiry or termination of this Agreement permit any act which infringes the trademarks used in connection with the Software.
3. 5.3 You shall indemnify PC Tools fully against all liabilities, costs and expenses which PC Tools may incur to a third party as a result of Your breach of this clause 5.
Term of License and Subscription
1. 6.1 This Agreement commences upon payment of the license fee (in the case of online downloads) or upon Your first installation and use of the Software (in the case of retail purchases or trialware) and may be terminated in the following circumstances:
  1. (a) if You are in breach of any term of this Agreement;
  2. (b) if You, being a corporation, become the subject of insolvency proceedings or have a liquidator, receiver or examiner appointed to You or become unable to pay Your debts;
  3. (c) if You, being a person rather than a company, become bankrupt;
  4. (d) if You, being a firm or partnership, are dissolved; or
  5. (e) if You destroy the Software and/or the Products for any reason.
2. 6.2 Upon termination, You or a representative nominated by You shall destroy any remaining copies of the Software and Products or otherwise return or dispose of such material in the manner directed by PC Tools.
3. 6.3 Termination pursuant to this clause shall not affect any rights or remedies which PC Tools may otherwise have under this Agreement or at law.
Export Restrictions
1. 7.1 PC Tools, its employees and its agents are subject to U.S. export control laws that prohibit or restrict (i) transactions with certain parties, and (ii) the type and level of technologies and services that may be exported. You agree to comply fully with all laws and regulations of the United States and other countries (Export Laws) to assure that neither the Software, nor any direct products thereof are (1) exported, directly or indirectly, in violation of Export Laws, or (2) are used for any purpose prohibited by Export Laws, including, without limitation, nuclear, chemical, or biological weapons proliferation.
2. 7.2 None of the Software or underlying information or technology may be downloaded or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, North Korea, Iran, Sudan, Syria or any other country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's List of Specially Designated Nationals or the U.S. Commerce Department's Denied Persons List, Unverified List, Entity List, Nonproliferation Sanctions or General Orders. By downloading or using the Software, You are agreeing to the foregoing and You are representing and warranting that You are not located in, under the control of, or a national or resident of any such country or on any such list, and that You acknowledge You are responsible to obtain any necessary U.S. government authorization to ensure compliance with U.S. law.
Assignment
The benefit of this Agreement shall not be dealt with in any way by You (whether by assignment, sub-licensing or otherwise) without PC Tools' written consent and this Agreement shall be binding on Your successors and assigns.
Waiver
Failure or neglect by either party to enforce at any time any of the provisions of this license Agreement shall not be construed or deemed to be a waiver of that party's rights under this Agreement.
Amending These Terms
PC Tools may amend any of the terms of this Agreement by (a) providing written notice to You of such amendments by email, Product smart alert; and/or (b) displaying such amendments or an amended copy of this Agreement to You during Your installation and/or execution of the Software or on the PC Tools Website. Without limiting the methods by which You may be notified of such amended terms, You acknowledge and agree that Your ongoing use of the Software after the date You are notified of any such changes of this Agreement, will constitute Your acceptance of such amended terms

If You do not agree to any amendments made by PC Tools to the terms of this Agreement, then You must uninstall the Software from Your Device and cease any further use of the Software. In such circumstances, You may also contact PC Tools to determine if You are eligible for a refund or partial refund of any purchase price paid to PC Tools in respect of the Software (subject to any conditions which PC Tools may place in respect of paying such a refund).
Governing Law and Jurisdiction
If the parties to this Agreement (as determined by Clause 1.1 above) are You and PC Tools Pty Ltd ACN 108 759 208, then this Agreement shall be governed by and construed according to the laws in force in Victoria, Australia and You irrevocably submit to the exclusive jurisdiction of the Courts of the State of Victoria and the Commonwealth of Australia. If the parties to this Agreement are You and PC Tools Limited (Irish Company Number 426110) then this Agreement will be governed by and construed according to the laws in force in the Republic of Ireland and You irrevocably submit to the exclusive jurisdiction of the Courts of the Republic of Ireland.

Se o Utilizador não pretender aceitar os seguintes termos, não seleccione o botão ["ACEITO"] e o Software não será instalado no computador, no telemóvel ou no computador de bolso ("Dispositivo"). Caso o Utilizador tenha comprado o Software, mas não tenha aceite os termos do presente Contrato e pretenda devolver o Software, contacte a PC Tools para saber se tem direito a ser reembolsado

Licença
1. 1.1 Se o Utilizador for residente na Oceânia na altura da compra ou da instalação inicial do Software (consoante o que ocorrer primeiro), o licenciante do Software é uma empresa australiana, PC Tools PTE Ltd (N.º de Registo Australiano 108 759 208) e as partes do presente Contrato serão o Utilizador e a PC Tools PTE Ltd (N.º de Registo Australiano 108 759 208). Se o Utilizador não for residente da Oceânia na altura da compra ou da instalação inicial do Software (consoante o que ocorrer primeiro), o licenciante do Software é uma empresa irlandesa, PC Tools Limited (N.º de Registo Irlandês 426110) e as partes do presente Contrato serão o Utilizador e a PC Tools Limited (N.º de Registo Irlandês 426110). Para efeitos do presente Contrato, o licenciante (seja a PC Tools Limited ou a PC Tools Pty Ltd) será designada como "PC Tools" Para efeitos do presente Contrato, "Oceânia" significa Samoa Americana, Antárctica, Austrália e respectivos territórios, incluindo Ilhas Heard e Ilhas McDonald, Ilhas Cocos (Keeling), Ilha do Natal, Ilhas Ashmore e Cartier e as Ilhas do Mar de Coral, Ilhas Cook, Fiji, Polinésia Francesa, Guam, Quiribati, Ilhas Marshall, Estados Federados da Micronésia, Nauru, Nova Caledónia, Nova Zelândia, Niue, Ilha Norfolk, Ilhas Marianas do Norte, Palau, Papua Nova Guiné, Ilhas Pitcairn, Samoa, Ilhas Salomão, Tokelau, Tonga, Tuvalu, Vanuatu e Ilhas Wallis e Futuna.
2. 1.2 A PC Tools concordou conceder a licença de utilização do Software ao Utilizador ao abrigo do presente Contrato e nos termos e condições definidos em baixo.
3. 1.3 A PC Tools concede ao Utilizador uma licença não exclusiva, intransmissível e revogável para:
  - (a) instalar e executar o Software;
  - (b) efectuar uma cópia adicional do Software apenas para efeito de cópia de segurança; e
  - (c) utilizar o Software rigorosamente de acordo com as disposições do presente Contrato durante o período de subscrição especificado para o Software.
4. 1.4 O número de Dispositivos em que o Utilizador pode instalar e executar o Software é especificado no momento da compra. Se o Utilizador pretender instalar o Software em mais Dispositivos que os especificados, só o poderá fazer após a recepção de uma autorização por escrito da PC Tools e pagamento de uma taxa de licença adicional, conforme estabelecido pela PC Tools.
5. 1.5 A licença para utilizar o Software conforme concedida no presente só permite a utilização da versão do Software que o Utilizador instalou ou adquiriu à PC Tools. Alguns produtos incluem o direito de receber actualizações automáticas, optimizações e melhorias do Software e estas serão fornecidas pela PC Tools à sua exclusiva discrição. Alguns produtos poderão requerer a actualização para uma versão mais recente se o Utilizador pretender beneficiar dos serviços de suporte da PC Tools relativos ao seu produto específico. Estas actualizações são normalmente oferecidas como parte da subscrição fornecida ou poderão ser necessárias como parte do ciclo de vida útil do produto da PC Tools. Se o Utilizador receber uma actualização ou melhoria desse tipo, esse Software será automaticamente considerado parte do Software licenciado ao Utilizador ao abrigo do presente Contrato. Se o Utilizador celebrar um outro contrato com a PC Tools para o fornecimento de qualquer outro produto ou actualizações do Software, esse Contrato regerá a utilização desses produtos e actualizações.
6. 1.6 O Utilizador reconhece que a PC Tools poderá oferecer-se para efectuar a manutenção e a actualização do Software, mas não está vinculado ao mesmo, excepto se o Utilizador tiver adquirido uma subscrição que lhe dá o direito de actualizar durante um período específico ou se o Utilizador adquirir um contrato de manutenção separado. Caso não seja especificado nenhum período de subscrição no momento da compra de uma licença para o produto, o período de subscrição será de um (1) ano a partir da data de compra original (no caso de transferências online) ou da data da instalação inicial do Software (no caso de compra numa loja). Caso o Utilizador pretenda receber informações sobre actualizações, consulte regularmente o website da PC Tools em www.pctools.com.
7. 1.7 Se o Utilizador tiver adquirido uma subscrição que lhe dá o direito de receber actualizações ou se o Utilizador tiver adquirido um contrato de manutenção separado, o Utilizador reconhece que, após a expiração do período de especificação ou de manutenção especificado, deixará de ter o direito de receber quaisquer actualizações sem a compra de uma renovação ou de uma nova subscrição ou contrato de manutenção. O Utilizador reconhece também que a PC Tools poderá limitar a funcionalidade do Software após a expiração de qualquer período de subscrição ou de manutenção, excepto se o Utilizador adquirir uma nova subscrição ou contrato de manutenção.
Taxa de licença
1. 2.1 No caso de existir uma taxa de licença a ser paga pelo Utilizador relativamente ao Software, o Utilizador não tem direito a utilizar o Software antes de efectuar tal pagamento e só será válido durante o período da subscrição (onde especificado). No caso de pagamento com cartão de crédito, o pagamento só será considerado concluído depois de autorizado pelo emissor da factura. Deverá ser paga uma taxa de licença adicional nas circunstâncias descritas na Cláusula 1.4.
2. 2.2 Se o Utilizador transferir uma versão gratuita ou experimental do Software, poderá utilizá-la num ou mais Dispositivos durante um período limitado de tempo (sujeito a qualquer restrição de tempo e/ou funcionalidade que possa ser integrada na versão experimental). Contudo, o Utilizador não tem direito a suporte técnico nem a todas as funcionalidades incluídas com o Software antes de o pagamento da taxa de licença.
Obrigações do Licenciado
1. 3.1 Como Licenciado, o Utilizador aceita pelo presente as seguinte obrigações:
  - (a) não imprimir, copiar, reproduzir, traduzir, adaptar, variar, alterar, mudar, efectuar engenharia inversa, descompilar ou modificar o Software de qualquer forma, que não seja a realização de uma cópia temporária do Software para efeitos de cópia de segurança, sem o consentimento expresso da PC Tools, excepto conforme expressamente autorizado no presente Contrato e sujeitos aos direitos do Utilizador ao abrigo da legislação aplicável;
  - (b) supervisionar e controlar a utilização do Software de acordo com os termos do presente Contrato;
  - (c) garantir que os seus funcionários, subcontratados e outros agentes com acesso autorizado ao Software têm conhecimento dos termos do presente Contrato;
  - (d) não fornecer ou disponibilizar o Software de qualquer forma a qualquer pessoa que não as indicadas no parágrafo (c) sem a autorização por escrito da PC Tools;
  - (e) não dar, ceder, transmitir, licenciar, sublicenciar, transferir, distribuir, divulgar, propagar ou publicar o Software de qualquer forma a qualquer pessoa nem tentar nenhuma dessas acções;
  - (f) não alterar, mudar, remover ou ocultar avisos ou outras indicações (incluindo avisos de direitos de autor) relativas à propriedade do Software;
  - (g) não aceder ou utilizar o Software em mais de um Dispositivo pessoal autónomo nem permitir que o Software seja acedido ou utilizado por mais de um utilizador em simultâneo, excepto conforme expressamente autorizado pelo presente Contrato;
  - (h) não efectuar acções que infringem os direitos de propriedade intelectual da PC Tools sobre o Software; e
  - (i) não utilizar o Software em ferramentas automáticas, semiautomáticas ou manuais concebidas para criar assinaturas de vírus, rotinas de detecção de vírus, quaisquer outros dados ou códigos para a detecção de códigos ou dados maliciosos.
2. 3.2 O Utilizador reconhece que a Licença concedida ao abrigo da Cláusula 1 não torna o Utilizador proprietário do Software nem implica a transferência ou transmissão de qualquer direito de autor ou qualquer outro direito de propriedade intelectual ou industrial subsistente no Software para o Utilizador.
3. 3.3 Se o Utilizador possui Software antivírus com licença, reconhece que o Software removerá códigos, como vírus, spyware, adware e malware. Nalgumas circunstâncias, a remoção de código detectado poderá resultar na violação de uma licença para utilizar o software do anfitrião que originalmente instalou o código e pode provocar a interrupção do funcionamento dos programas do anfitrião. O Utilizador concorda consultar os termos de qualquer contrato de licença do programa do anfitrião antes de autorizar a remoção de qualquer vírus, spyware, adware ou malware associado a esse programa.
Garantia
1. 4.1 O Utilizador reconhece pelo presente que o Software poderá ter interrupções e não é possível garantir estar livre de erros e reconhece ainda que a existência de tais erros não constitui uma violação do presente Contrato por parte da PC Tools. A PC Tools não garante, especificamente, que o Software (i) detectará e/ou removerá todos os vírus, spyware, adware, malware, cavalos de Tróia, registadores de sequência de teclas e trackware conhecidos, ou detectará todas as infecções e cookies de controlo do browser existentes no seu Dispositivo, nem que o Software não irá indicar incorrectamente um vírus num ficheiro ou sistema não infectado por esse vírus; (ii) recuperará ou detectará todos os ficheiros eliminados recuperados existentes no seu Dispositivo; (iii) bloqueará todas as ameaças no seu Dispositivo, incluindo de websites maliciosos ou potenciais hackers; (iv) detectará e/ou filtrará todas as mensagens de spam ou não solicitadas de correio electrónico; ou (v) detectará, removerá ou corrigirá quaisquer erros no seu Dispositivo, incluindo, mas sem se limitar a, quaisquer erros no seu ficheiro de registo do Windows ou outros erros do sistema operativo. Se o Software for uma versão beta, o Utilizador reconhece e aceita que (i) o Software poderá incluir erros e falhas e poderá não funcionar conforme pretendido ou de acordo com as respectivas especificações; e (ii) o Utilizador assume todos os riscos na utilização do Software e aceita tomar os devidos cuidados na instalação, execução e teste do Software no sistema do seu Dispositivo.
2. 4.2 Os sistemas operativos específicos nos quais o Software foi concebido para executar serão indicados regularmente pela PC Tools ("SO compatível"). O Utilizador reconhece pelo presente que o Software poderá ter interrupções e não é possível garantir estar livre de erros e reconhece ainda que a existência de tais erros não constitui uma violação do presente Contrato por parte da PC Tools. A PC Tools não garante, especificamente, que o Software (i) detectará e/ou removerá todos os vírus, spyware, adware, malware, cavalos de Tróia, registadores de sequência de teclas e trackware conhecidos, ou detectará todas as infecções e cookies de controlo do browser existentes no seu Dispositivo, nem que o Software não irá indicar incorrectamente um vírus num ficheiro ou sistema não infectado por esse vírus; (ii) recuperará ou detectará todos os ficheiros eliminados recuperados existentes no seu Dispositivo; (iii) bloqueará todas as ameaças no seu Dispositivo, incluindo de websites maliciosos ou potenciais hackers; (iv) detectará e/ou filtrará todas as mensagens de spam ou não solicitadas de correio electrónico; ou (v) detectará, removerá ou corrigirá quaisquer erros no seu Dispositivo, incluindo, mas sem se limitar a, quaisquer erros no seu ficheiro de registo do Windows ou outros erros do sistema operativo. Se o Software for uma versão beta, o Utilizador reconhece e aceita que (i) o Software poderá incluir erros e falhas e poderá não funcionar conforme pretendido ou de acordo com as respectivas especificações; e (ii) o Utilizador assume todos os riscos na utilização do Software e aceita tomar os devidos cuidados na instalação, execução e teste do Software no sistema do seu Dispositivo.
3. 4.3 No caso de quaisquer termos, condições, representações ou garantias estarem implícitas no presente Contrato por estatuto, direito comum ou equidade ("Condições Previstas") e não podendo ser legalmente excluídas, as Condições previstas aplicar-se-ão ao presente Contrato, excepto se a responsabilidade da PC Tools pela violação de qualquer Condição Prevista seja limitada, até ao limite permitido por lei, à discrição da PC Tools, a um ou mais dos seguintes:
  - (a) à substituição do Software a que a violação diz respeito ou ao fornecimento de Software equivalente;
  - (b) à reparação do Software;
  - (c) ao pagamento do custo de substituição do Software ou de aquisição de Software equivalente; ou
  - (d) ao pagamento do custo da reparação do Software.
4. 4.4 Se a responsabilidade da PC Tools pela violação de qualquer Condição Prevista for susceptível de exclusão, está excluída no presente até ao limite máximo permitido por lei.
5. 4.5 Excepto conforme indicado pelas Condições Previstas (caso existam), que não permitem a exclusão ou a limitação, ou conforme definido expressamente nos seguintes termos:
  - (a) a PC Tools não estabelece quaisquer garantias relativas ao Software, incluindo garantias relativas ao desempenho ou adequação para uma finalidade do Software (excepto que a PC Tools tem direito a conceder ao Utilizador os direitos definidos no presente Contrato);
  - (b) em circunstância alguma, o Utilizador poderá interpor nenhuma acção legal contra, ou terá direito de exigir ou de recuperar de, a PC Tools pela ou relativa a qualquer perda, danos ou prejuízos (incluindo, mas sem limitar a, perda de lucros, perda indirecta ou consequente, danos ou lesão) resultantes do fornecimento ou da utilização do Software ou de qualquer violação destes termos; e
  - (c) sujeito ao parágrafo (b) anterior, a responsabilidade máxima da PC Tools em relação ao Utilizador no que respeita a qualquer violação do presente Contrato ou à sua utilização do Software será o montante que o Utilizador pagou à PC Tools pelo Software e, se o Utilizador não tiver pago qualquer montante pelo Software, será o montante de US $1 (um dólar dos Estados Unidos).
6. 4.6 A PC Tools não será responsável por quaisquer danos indirectos resultantes de uma violação do presente Contrato ou do fornecimento do Software.
7. 4.7 O Utilizador reconhece que decidiu pessoalmente adquirir o Software e não contou com qualquer representação por parte da PC Tools que não tenha sido expressamente indicada no presente Contrato nem com quaisquer descrições, ilustrações ou especificações incluídas em qualquer documento, incluindo catálogos ou material publicitário produzido pela PC Tools.
Copyright e Marcas comerciais
1. 5.1 O Utilizador reconhece que o Software e todos os produtos relacionados (incluindo, mas sem se limitar a, manuais e documentação do Dispositivo) ("Produtos") estão sujeitos a direitos de autor. Como tal e durante ou após a expiração ou término do presente Contrato, o Utilizador não permitirá qualquer acção que infrinja esses direitos de autor e, sem limitar a generalidade do seguinte, o Utilizador reconhece especificamente que não poderá copiar o Software ou os Produtos, excepto se expressamente autorizado no presente Contrato.
2. 5.2 O Utilizador não permitirá, durante e após a expiração ou término do presente Contrato, qualquer acção que infrinja as marcas comerciais utilizadas com o Software.
3. 5.3 O Utilizador aceita não executar nem instalar o Software em nenhum sistema operativo diferente de um SO compatível. O Utilizador reconhece e aceita que o Software poderá não executar correctamente e poderá interferir com outro software caso seja executado num sistema operativo que não um SO compatível.
Rescisão da licença e subscrição
1. 6.1 O presente Contrato tem início após o pagamento da taxa de licença (no caso de transferências online) ou após a instalação inicial e utilização do Software (no caso de compras em lojas ou trialware) e poderá ser rescindido nas seguintes circunstâncias:
  1. (a) se o Utilizador violar qualquer termo do presente Contrato;
  2. (b) se o Utilizador, no caso de uma empresa, seja sujeito a acções de insolvência, lhe seja indicado um liquidatário, depositário ou inspector ou não lhe seja possível pagar as suas dívidas;
  3. (c) se o Utilizador, no caso de um particular, entre em bancarrota;
  4. (d) se o Utilizador, no caso de firma ou sociedade, esta seja dissolvida; ou
  5. (e) se o Utilizador destruir o Software e/ou os Produtos por qualquer motivo.
2. 6.2 Após o término do presente, o Utilizador ou um representante nomeado pelo Utilizador destruirá todas as cópias existentes do Software e dos Produtos, devolverá ou eliminará tais materiais conforme indicado pela PC Tools.
3. 6.3 O término do presente de acordo com a presente cláusula não afectará quaisquer direitos ou recursos que a PC Tools possa ter ao abrigo do presente Contrato ou da lei.
Restrições de exportação
1. 7.1 A PC Tools, os seus funcionários e agentes estão sujeitos às leis de controlo de exportação americanas que proíbem ou restringem (i) transacções com determinadas partes e (ii) o tipo e nível de tecnologias e serviços que podem ser exportados. O Utilizador aceita cumprir na íntegra todas as leis e regulamentações dos Estados Unidos e de outros países (Leis de Exportação) para assegurar que o Software e quaisquer produtos directos do mesmo não são (1) exportados, directa ou indirectamente, em violação das Leis de Exportação, ou (2) utilizados para qualquer finalidade proibida pelas Leis de Exportação, incluindo, mas sem se limitar a, a proliferação de armas nucleares, químicas ou biológicas.
2. 7.2 Nenhuma parte do Software ou informações ou tecnologia adjacente poderá ser transferida, exportada ou reexportada (i) para (um cidadão natural ou residente em) Cuba, Coreia do Norte, Irão, Sudão, Síria ou qualquer outro país relativamente ao qual os EUA embargaram a exportação de bens; ou (ii) para alguém incluído na Lista de Cidadãos Nacionais Especialmente Indicados do Departamento do Tesouro dos EUA ou nas Listas Não Verificadas, de Entidades e Pessoas Não Autorizadas, Sanções de Não Proliferação e Ordens Gerais do Departamento de Comércio dos EUA. Com a transferência ou utilização do Software, o Utilizador aceita o supramencionado e está a representar e a garantir que não se encontra em, não está sob o controlo de, nem é um cidadão natural ou residente em nenhum desses países nem consta de nenhuma de tais listas e o Utilizador reconhece que é responsável por obter qualquer autorização do governo dos EUA para garantir a conformidade com as leis dos EUA.
Transmissão
Os benefícios do presente Contrato não serão negociados de qualquer forma pelo Utilizador (seja por transmissão, sublicenciamento ou de outra forma) sem a autorização por escrito da PC Tools e o presente Contrato será vinculativo aos sucessores e representantes do Utilizador.
Renúncia
A falha ou negligência de qualquer parte na implementação de qualquer disposição do presente Contrato de Licença não será interpretada ou considerada uma renúncia dos direitos dessa parte ao abrigo do presente Contrato.
Alterações aos termos
A PC Tools poderá alterar qualquer um dos termos do presente Contrato através (a) de aviso escrito para o Utilizador de tais alterações por correio electrónico ou alerta inteligente do Produto; e/ou (b) da apresentação de tais alterações ou de uma cópia alterada do presente Contrato ao Utilizador durante a instalação e/ou execução do Software ou no website da PC Tools. Sem limitar os métodos de notificação de tais termos alterados, o Utilizador reconhece e aceita que a utilização contínua do Software após a data da notificação de tais alterações do presente Contrato significará a aceitação das mesmas.

Se o Utilizador não aceitar quaisquer alterações efectuadas pela PC Tools aos termos do presente Contrato, Utilizador terá de desinstalar o Software do seu Dispositivo e terminar qualquer utilização do Software. Nestas circunstâncias, o Utilizador poderá também contactar a PC Tools para determinar se tem direito a um reembolso total ou parcial de qualquer montante pago à PC Tools relativo ao Software (sujeito às condições que a PC Tools pode estabelecer para o pagamento de tal reembolso).
Lei aplicável e foro competente
Se as partes do presente contrato (conforme determinado na Cláusula 1.1 supra) forem o Utilizador e PC Tools PTE Ltd (N.º Registo Australiano 108 759 208), o presente Contrato será regido e interpretado de acordo com as leis em vigor em Victoria, Austrália e o Utilizador aceita a foro exclusivo dos Tribunais do Estado de Victoria e da Commonwealth da Austrália. Se as partes do presente Contrato forem o Utilizador e a PC Tools Limited (N.º de Registo Irlandês 426110), o presente Contrato será regido e interpretado de acordo com as leis vigentes da República da Irlanda e o Utilizador aceita irrevogavelmente o foro exclusivo dos Tribunais da República da Irlanda.
